Bankruptcy Case Files, 1872-1879

This series includes records relating to the assets and debts of the bankrupt, the actions of the court and the Register in Bankruptcy, and the final disposition of the case. A typical case file normally contains the petition, schedule of debts, a list of the names and addresses of creditors, and a record of the amount due; inventories of real and personal property, proof of publication of bankruptcy notices, notices to creditors, oaths of assignees, orders of reference, orders of bankruptcy, final discharges, and related papers filed in bankruptcy proceedings. It may contain some or all of the following items: *"Petition by Debtor." *"Schedule A-1: Statement of all Creditors who are to Paid in Full, or to whom Priority is Secured." This schedule gives the names of the creditors, residence and occupations of creditors, amount, when and where contracted, and nature and consideration of the debt. *"Schedule A-2: Creditors Holding Securities." This form contains the same type of information as Schedule A-1. *"Schedule A-3: Creditors whose Claims are Unsecured." This form contains the same type of information as Schedule A-1. *"Schedule A-4: Liabilities on Bills Discounted Which Ought to be Paid By the Acceptors." *"Schedule A-5: Accommodation Paper." A schedule that lists the dates of notes or bills, and when due, with the names, residences, and business or occupation of the makers, of drawers, and acceptors thereof, along with the amount of the note or bill. *"Oath to Schedule A" by the bankrupt petitioner. *"Schedule B-1: Interest in Lands." This lists the description of all real estate owned or held by the petitioner, encumbrances upon the land, statement of all particulars relating to the land, and its estimated value. *"Schedule B-2: Personal Property." A listing of all household goods and furniture, household stores, wearing apparel, and ornaments with their estimated value. *"Schedule B-3: Choses in Action." A list of debts due petitioners on open account and the amount. *"Schedule B-4: Property in Reversion, Remainder, or Expectancy." A listing of interest in land and the amount. *"Schedule B-5: Property claimed by Petitioner as Excepted." This lists each item and estimated value. *"Schedule B-6: A True List of all Books, Papers, Deeds, and Writings." *"Oath to Schedule B" by the bankrupt petitioner. *"Order of Reference." Order by the judge assigning the case to one of the Registers in Bankruptcy. *"Warrant to Marshal as Messenger." This required the U.S. Marshal to have published notices of the bankruptcy petition in a selected newspaper. In addition, he was to notify each of the named creditors (either by mail or personally) of the action. This warrant also indicates when the Marshal complied with the terms of the warrant and his costs. *"Certificate of Exempted Property." A schedule of property exempted from the bankruptcy proceedings, listing each piece of property and its estimated value. *"Oath of Bankrupt to be Taken before Final Discharge." *"Notification to Assignee of his Appointment." *"Bond of Assignee." *"Petition of Assignee for Power to Sell or Relieve Property from Lien." *"Order Concerning Sale of Real Estate by Assignee." *"Petition of Bankrupt for His Discharge." *"Assignee's Return Where There are No Assets." *"Accounts of the Register in Bankruptcy." *"Letter of Attorney to Represent Creditor." *"Proof of Debt without Security (By Creditor)." *"Certificate of Protection (Given by the Court or Register)." *"Adjudication of Bankruptcy on Debtor's Petition." *"Petition for Discharge and Order of Publication and Notice thereof." *"Certification of Publication and Receipt." *"Notification of Bankruptcy to Creditors." *"Assignees' or Trustees' Notice of Appointment." *"Order to the High Constable to make restitution to a creditor." In addition, there are sheets completed by the Register in Bankruptcy detailing actions taken and / or filed. Often, two copies of the petition by debtor and the various A and B schedules are included. One was filed with the court, and the other accompanied the case to the Register in Bankruptcy who returned it to the court upon conclusion of the case.
